The agreement between you and us when you use Kept. Written to be read rather than skipped.
Kept is provided by WayPointLabs, 1111B S Governors Ave STE 48363, Dover, DE 19904, United States ("we", "us"). By using Kept you agree to these terms. If you do not, do not use it.
Kept lets you create a shared photo roll for an event. Guests join by scanning a code, take a limited number of photographs, and nobody can view any of them until the roll develops at the time you set.
Guests join without an account, using an access token stored on their device. Anyone holding that device can use that guest's place on the roll, so treat your device accordingly. If you create an account, you are responsible for keeping access to it secure.
Anyone with the join code or link can join a roll while it is open. Share the code with the people you want on the roll and nobody else.
Rolls up to five guests are free. Larger rolls are a one-time purchase for that event. There is no subscription, nothing renews, and you are not charged again when the roll develops.
Purchases are processed by the Apple App Store or Google Play under their terms. Refunds are handled by Apple or Google, not by us, and follow their policies. If something goes wrong on our side, contact us and we will try to put it right.
Prices are shown in your local currency by the relevant store and may change. A change never affects a purchase you have already made.
You keep ownership of every photograph you take. You give us only the permission we need to run the service: to store your photographs, to show them to the other people on that roll once it develops, and to let people on the roll download them.
We will not use your photographs to promote Kept, publish them, or give them to anyone outside your roll, unless you give us permission for that specific photograph in writing.
You are responsible for what you photograph. Do not use Kept to photograph people who have not agreed to it, to photograph anyone in a place where they would expect privacy, or in any way that breaks the law where you are.
If you create a roll for an event, make it clear to your guests that photos are being collected and shared with everyone on the roll.
We can remove content and end access for anyone doing these things, without notice where the situation warrants it.
The person who created a roll can remove photographs from it. Anyone who appears in a photograph can ask us to remove it, whether or not they use Kept, by writing to privacy@kept.film.
We keep rolls indefinitely and do not delete them on a schedule. After about four months a roll moves into deep archive, and retrieving it then takes between 12 and 48 hours. Save anything you want immediate access to.
We are not a backup service. Keep your own copy of anything that matters.
We work to keep Kept running, but we do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we shut the service down, we will give reasonable notice and a way to export your rolls first.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us for the event in question.
Nothing here limits liability that cannot legally be limited. If you are a consumer, you keep every right your local consumer law gives you, and nothing in these terms takes those away.
This agreement is between you and us, not with Apple or Google. They are not responsible for Kept or for supporting it. Apple is a third-party beneficiary of these terms and may enforce them against you.
We may update these terms. If a change materially affects you we will say so in the app before it takes effect. Continuing to use Kept after that means you accept the change.
These terms are governed by the laws of the State of Delaware, United States, and the courts of the State of Delaware, United States have exclusive jurisdiction, except where your local consumer law entitles you to bring a claim where you live.
